Kerala Psychiatrists Advocate Confidentiality in De-addiction Treatment Under Mental Health Care Act

Kerala is witnessing a widespread campaign against substance abuse, with the State government, law enforcement agencies, and various societal sections collaborating to address the issue. Psychiatrists in Kerala are advocating for treating substance addiction as a medical disorder requiring proper treatment and rehabilitation. The Indian Psychiatric Society’s Kerala branch emphasizes the need for empathetic treatment for patients voluntarily seeking help. Recently, the police requested personal details and abstinence periods of patients undergoing or having completed de-addiction treatment from mental health institutions. However, psychiatrists argue that such requests are not legally valid under the Mental Health Care Act, 2017. Section 27(1) of the Act ensures the right to confidentiality for individuals regarding their mental health and treatment. Only specific authorities, such as the Mental Health Review Board, Central Mental Health Authority, High Court, or Supreme Court, can order the release of such information. Additionally, Section 64A of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, provides immunity from prosecution for individuals volunteering for treatment in government-recognized institutions, though this immunity can be revoked if treatment is incomplete. Psychiatrists stress that timely medical care is crucial for the well-being of individuals with substance addiction, and a safe, secure environment free from legal retribution is essential for effective treatment. Fear of legal consequences may deter individuals from seeking treatment, potentially increasing substance-related crimes. According to Dr. T.C. Vishnu, State treasurer of the society, most patients seeking treatment for substance abuse are aged 15 to 25, with increasing numbers from lower socio-economic backgrounds. Peer pressure, impulsive behavior, and experimentation are key factors driving substance use. Evidence-based approaches, including intervention, detoxification, relapse prevention, harm reduction, and follow-up care, supported by mental health professionals and organizations, are vital in addressing the issue.

Volunteer Group Rescues 23 Whale Sharks Along Thiruvananthapuram Coastline

A volunteer rescue group, led by Ajith Shanghumughom of the Wildlife Trust of India (WTI), has been actively saving whale sharks stranded along the coastline of Thiruvananthapuram and Kanyakumari district. The group has rescued 23 whale sharks since 2021, particularly during their migratory season from January to March. Whale sharks, known as gentle giants, often get ensnared in fishing nets, prompting fishers to cut their nets to free them. The rescue group has utilized online video tutorials to improve their techniques and has also been educating local communities about marine wildlife conservation. The Indian government has supported these efforts by banning whale shark hunting in 2001 and the export of dried shark fins and meat in 2019, along with providing ₹25,000 compensation to fishers who lose their nets. Conservation efforts have shown positive results, with increased whale shark activity off the Indian coast, as noted by A. Bijukumar, Professor at the University of Kerala.

US-India Bilateral Trade Agreement Negotiations Focus on Tariff Reciprocity and Market Access

US President Donald Trump is intensifying efforts to establish a Bilateral Trade Agreement (BTA) with India, focusing on reciprocity in tariffs, market access for agriculture, and addressing the bilateral trade deficit. Former Assistant US Trade Representative (AUSTR) Mark Linscott, who negotiated with India during the previous Trump administration, revealed that Trump is determined to impose reciprocal tariffs on April 2, targeting countries with significant trade deficits with the US, including India. The US-India trade deficit, though not the largest, remains a concern for Trump, who has long emphasized reciprocity in trade. Recent negotiations in Delhi explored the possibility of lowering India’s tariffs to align with the US average of 3.4%, compared to India’s current 17%. The collapse of the 2019-2020 mini-trade deal, which covered $10 billion in bilateral trade, has influenced the current negotiations. A comprehensive BTA, expected to be finalized in phases by 2026-2027, will address non-tariff barriers, digital trade, and agricultural market access, with the first phase targeted for completion by fall 2024. The removal of India’s 6% Equalisation Levy on digital transactions is also under discussion as a goodwill gesture.
